Can You Be Fired for Whistleblowing?

  2. Can You Be Fired for Whistleblowing?

An employee “whistleblows” when he chooses to report his employer for engaging in illegal activity. For example, an employee who alerts authorities to fraudulent practices within an organization is blowing the whistle on his employer. Reporting illegal activity is the morally right thing to do, but can it get an employee fired? Here’s what you need to know:

Whistleblower Protection Laws

Oklahoma is an employment-at-will state, which means that both employers and employees can end their working relationship at any time. However, there are some exceptions to this rule, several of which apply to whistleblowers. The state of Oklahoma has passed a number of laws that protect whistleblowers from retaliation, including the termination of their employment.

For example, the Oklahoma Whistleblower Act provides protection to whistleblowers at state government agencies. This law ensures that whistleblowers will not be fired for reporting certain types of illegal activity, including violations of the constitution or actions that put the public in danger.

According to Okla. Stat. tit. 40, § 199, whistleblowers that report violations of certain labor laws are also protected from retaliation. This would include violations of child labor, safety, minimum wage, and other labor laws.

These are just two of the state laws that protect whistleblowers in the state of Oklahoma. These laws were established to ensure that whistleblowers never fear the consequences of doing the right thing. But unfortunately, some employers choose to retaliate against whistleblowers despite these laws.

What To Do After Being Wrongfully Terminated

If you’ve been fired due to your decision to report illegal activity, it’s important to speak to an attorney as soon as possible. The laws protecting whistleblowers are complex, and it’s not easy to hold your employer accountable for your wrongful termination, which is why it’s best to get an attorney’s help. An attorney can file a wrongful termination claim against your employer and fight for the compensation you deserve. Experienced attorneys can help whistleblowers recover compensation for lost wages, out-of-pocket expenses, and attorneys’ fees. Sometimes, the court will even order your employer to reinstate you to your former position since you should have never been removed in the first place.
